Notes for: Benjamin Franklin Jaco
Benjamin Franklin Jaco was not the natural son of Elizabeth Prunty, but rather was born out of wedlock to Susan(nah) Tucker, with his birth name being Benjamin Tucker. This is based to some extent on partially illegible records of an 1846 court case in Doddridge County, in which Benjamin Tucker, age 3, was bound over to Luke Jaco. (Another court proceeding established Luke Jaco as the father of Emma Tucker, who was born at the home of James Fleming as the illegitimate daughter of Susannah Tucker.) Partial transcripts of the 1846 proceedings are as follows:
May 1846 Term
"On motion of one of the overseers of the (illegible) ordered that some one at their body (illegible) bind (illegible) out Benjamin Tucker, an illegitimate child age 3 years, on 21st Jun 1846 to Luke Jaco until he arrives to the age of twenty one."
Book 1, Page 82, August 1846 Term
"Ordered that Luke Jaco show cause at the next term of this court why an order made by this court at the last (illegible) term thereof binding or ordering to be bound Benjamin Tucker (illegible) illegitimate child to him the said Luke Jaco should not be rescinded."
